Terms of Service

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use WorkCA. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your Account

You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly at support@work-ca.ca if you suspect unauthorized use. You agree to provide accurate, current information and to keep it up to date.

3. Job Seekers

WorkCA lets you search and apply to jobs free of charge. When you apply, the information in your application is sent to the employer, who handles it under their own practices. WorkCA is a platform that connects candidates and employers — we are not a party to, and do not guarantee, any hiring decision, interview, or outcome.

4. Employers

If you post jobs, you agree that your listings are accurate, lawful, non-discriminatory, and for genuine opportunities. You must have the right to advertise each position. Prohibited postings include those that are misleading, fraudulent, require payment from applicants, or violate employment, human-rights, or accessibility laws.

Where applicable (for example, under Ontario’s AODA), you are responsible for meeting your own legal obligations to candidates with disabilities, including notifying applicants that accommodations are available during recruitment. You are solely responsible for your hiring process and your treatment of applicant data.

We may remove any listing, or suspend any account, that we reasonably believe violates these Terms or applicable law.

5. Aggregated Listings

Some listings on WorkCA are sourced from the Government of Canada’s Job Bank open data and other third-party sources. We provide these for convenience and do not control or guarantee their accuracy, completeness, or availability. A listing may have changed or closed since it was published. Applying to an external listing redirects you to the original source, which has its own terms.

6. Payments & Subscriptions

Job seekers use WorkCA free of charge. Employers may post a first job free for a limited period; continued or additional posting requires a paid subscription. Prices are shown in Canadian dollars and may change with notice.

Payments are processed by Stripe; we do not store full payment card details. Subscriptions renew automatically until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. Promotional offers (such as founding-member benefits) apply only as described at the time they are offered.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Post false, misleading, defamatory, or infringing content.
• Harvest, scrape, or collect data about other users, or send unsolicited messages.
• Attempt to access accounts, data, or systems you are not authorized to access, or interfere with the security or operation of the Service.
• Upload malware or attempt to disrupt the platform.
• Misrepresent your identity or your affiliation with any person or organization.

8. Your Content

You retain ownership of the content you submit (such as profiles, résumés, job postings, and company information). You grant WorkCA a limited, non-exclusive licence to host, store, display, and process that content as needed to operate and provide the Service (for example, showing a job posting to seekers, or delivering an application to an employer). You are responsible for ensuring you have the rights to the content you submit.

9. Intellectual Property

The WorkCA name, logo, software, design, and original content are owned by WorkCA and protected by applicable laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing, application, or interaction will lead to employment or a hire. WorkCA does not endorse any employer, job seeker, or listing.

11. Limitation of Liability

To the fullest extent permitted by law, WorkCA and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, or profits, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless WorkCA from any claims, losses, or expenses arising out of your content, your use of the Service, or your breach of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will continue to apply.

14. Changes

We may update the Service and these Terms from time to time. When we make material changes to the Terms, we will update the "Last updated" date and, where appropriate, provide notice. Your continued use of the Service after changes take effect means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada, subject to any mandatory consumer-protection rights in your province of residence.
